## 1. Acceptance of Terms

By downloading, installing, or using ShiftTrak (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

## 2. License to Use

TJXLABS grants you a limited, non-exclusive, non-transferable, revocable license to use ShiftTrak for personal, non-commercial purposes in accordance with these Terms.

You may NOT:

• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Distribute, sell, lease, or sublicense the App
• Remove any copyright or proprietary notices
• Use the App for any illegal purposes

## 3. Free and PRO Features

### Free Version

• ShiftTrak offers free features available to all users
• Free features may be limited or changed at our discretion

### PRO Upgrade

• PRO features are available through a one-time purchase or promotional unlock
• Early Adopter Program: Users who install during the promotional period receive lifetime PRO access at a discounted rate
• PRO features include: PDF Export, CSV Export, Custom Themes, Advanced Analytics, Live Timer, and more
• All PRO purchases are final and non-refundable except as required by law

### Promotional Pricing

• Early adopter pricing is subject to change
• Promotional periods may end at any time
• Users who purchase during promotional periods retain access at the promotional price

## 4. User Data and Privacy

• All your data is stored locally on your device
• We do not collect, store, or access your shift data, earnings, or personal information
• We collect anonymous crash reports via Firebase Crashlytics to improve app stability

## 5. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND.

We make no warranties that:

• The App will be error-free or uninterrupted
• Calculations (earnings, tax, overtime) are accurate for your specific situation
• The App will meet your requirements

Tax Calculations: Tax estimates are for informational purposes only and should not be considered tax advice. Consult a tax professional for accurate tax information.

Accuracy: While we strive for accuracy, you are responsible for verifying all calculations and using the App as a tool, not as authoritative financial records.

## 6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TJXLABS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the App
• Errors in calculations or data loss

Maximum Liability: Our total liability shall not exceed the amount you paid for the App (if any).

## 7. User Responsibilities

You are responsible for:

• Maintaining the security of your device
• Backing up your data (the App stores data locally)
• Verifying all calculations and earnings
• Complying with applicable laws and regulations
• Maintaining accurate records for tax and employment purposes

## 8. Updates and Changes

We may:

• Update the App to add features, fix bugs, or improve performance
• Modify or discontinue features at any time
• Update these Terms with notice in the App or on this page

Continued use of the App after changes constitutes acceptance of updated Terms.

We reserve the right to:

• Terminate or suspend your access to the App at any time
• Discontinue the App or any features

You may stop using the App at any time by uninstalling it.

## 10. Geographic Restrictions

ShiftTrak is designed for use in Australia with Australian tax calculations. While available internationally, tax and wage calculations may not apply to other jurisdictions.

## 11. Third-Party Services

The App uses Firebase Crashlytics (by Google) for crash reporting. Your use of this service is subject to Google’s Terms of Service.

## 12. Intellectual Property

All content, features, and functionality of ShiftTrak are owned by TJXLABS and protected by copyright, trademark, and other intellectual property laws.

The ShiftTrak name, logo, and all related marks are trademarks of TJXLABS.

## 13. Indemnification

You agree to indemnify and hold TJXLABS harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or regulations

## 14. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.

## 15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

## 16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TJXLABS regarding the App.
